tertius1. Eligibility and access
By requesting or using the Tertius private beta, you confirm that you can legally agree to these terms and will use the software only for lawful evaluation. Tester access is personal unless Tertius explicitly approves organizational distribution. Do not publish, resell, or redistribute private installer links or installer files, and do not share sign-in codes, session credentials, or account access.
2. Beta status
Tertius is pre-release software. Features may be incomplete, inaccurate, unavailable, changed, or removed. The installer is not yet code-signed and may prompt a Windows SmartScreen warning. Access may be suspended or ended to protect the service, control costs, respond to abuse, or close the beta.
3. Recordings, consent, and lawful use
You are responsible for having the right, notice, and consent required to record, upload, transcribe, and transform speech or media. Laws differ by location and context. Do not use Tertius to intercept communications, violate privacy or intellectual-property rights, process unlawful content, impersonate others, or facilitate harm.
4. Tester account and managed allowance
The current beta uses a passwordless Tertius tester account and does not require your own OpenAI API key. Tertius keeps its OpenAI credential on the server. The free tester allowance currently includes 120 transcription minutes per month plus managed outcome processing, with additional request, daily, and concurrency limits.
Allowances and limits may change, and access can be reduced, paused, or ended as capacity, cost, security, and abuse patterns are measured. Unused allowance is not money, credit, or a promise of future service. Production subscription or credit pricing has not been announced, and beta access does not create a lifetime-free entitlement.
5. Generated and transcribed output
Transcripts and transformed outcomes may be incomplete, incorrect, misleading, or unsuitable. Verify recordings, names, numbers, dates, quotations, commitments, and material facts before use. Do not rely on Tertius output as legal, medical, financial, employment, safety, or other professional advice or as the sole basis for a consequential decision.
6. Data and security
The current data flow is described in the privacy summary. You are responsible for deciding whether the managed Tertius service, OpenAI provider processing, local text history, and beta security posture are appropriate for the material. Keep separate backups of work you cannot afford to lose.
7. Acceptable technical use
Do not bypass the email gate, probe private download URLs, defeat rate limits or access controls, introduce malware, disrupt the service, reverse engineer service-side protection, automate abusive requests, or use another person’s credentials. Security research requires advance authorization.
8. Feedback
You may provide feedback, bug reports, and workflow suggestions. Unless agreed otherwise in writing, Tertius may use that feedback to improve the product without payment or obligation. Do not include confidential third-party content in feedback.
9. Warranty and liability
To the maximum extent permitted by applicable law, the beta is provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, fitness for a particular purpose, or non-infringement. Tertius is not responsible for lost work, missed commitments, exhausted allowances, decisions based on output, or indirect or consequential loss arising from beta use. Rights that cannot legally be excluded remain unaffected.
10. Changes and ending access
These terms may be updated as the product, backend, allowance, business model, or providers change. The updated date will identify the current version. Stop using the beta if you do not accept an update. You may stop at any time, sign out, remove the application, and delete local data.
These terms are a plain-language beta baseline, not a substitute for legal review where a specific jurisdiction, organization, or regulated workflow requires it.
